Once a Tenant fails to pay, a Landlord will serve a 3 Day NoticeIf they do not pay, they will file the Eviction.  As a result, they have 5 days to respond.  Accordingly, if they fail to respond, a Default will be entered. On the other hand,  if they do respond, we will file a Motion to Strike.  However, some Courts will set the case for a Final Hearing.  If the Judge rules for the Landlord, a Judgment will be entered.  This takes between 4 to 5 weeks.

If a Tenant violates a section of the lease that does not pertain rent, we will send them a 7 Day Notice.  Examples include:

C.  parking in an unauthorized manner or permitting such parking;

D.  failing to keep the premises clean and sanitary.

3.     Security Deposit Disputes

83.49(3) requires a Landlord to return the Deposit within 15 days or send a claim to the Tenant within 30 days. Thereafter, they have 15 days to object to the claim. However, if they cannot resolve the dispute, our office will file a Lawsuit against the Tenant.  Accordingly, if the Court rules for the Landlord, they will be able to keep it. 

4.     Termination of Lease Notices

If a Landlord wants to terminate a month-to-month lease, we send a 15 day notice.  Accordingly, if they remain in the property, they are a Holdover Tenant.  As a result, they can file an Eviction.  In addition, they can recover double rent.
